These Terms & Conditions ("Terms") form a legally binding agreement between you and FinGo Digital ("FinGo", "the Company", "we", "us", "our"). By accessing the website, using our services, placing an order, or registering as a seller or partner, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the platform.
"Platform" means the FinGo Digital website, WhatsApp-based services, catalogues, and any related interface operated by FinGo. "Buyer" means any person who browses, enquires, or purchases through the Platform. "Seller" means any person or entity approved to list and sell goods or services through the Platform. "Partner" means any organisation or corporate entity that enrols with FinGo. "Content" means any text, image, price, listing, or material displayed on the Platform. "User" means any Buyer, Seller, Partner, or visitor.
FinGo operates as a technology platform and intermediary that connects women entrepreneurs across Pakistan with Buyers, primarily through WhatsApp. FinGo facilitates discovery, communication, and ordering. Unless expressly stated in writing, FinGo is not the seller, manufacturer, importer, or provider of the goods and services listed, and does not take title to them. Contracts of sale are formed directly between the Buyer and the relevant Seller. FinGo's role is limited to providing the facilitating technology and, where applicable, payment routing through licensed third-party providers.
You agree that you will not, directly or indirectly:
The FinGo name, logo, design, software, and all Platform Content created by FinGo are the exclusive property of FinGo and are protected by applicable intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose only. Sellers retain ownership of their own product Content but grant FinGo a worldwide, royalty-free licence to host, display, reproduce, and promote that Content for the purpose of operating and marketing the Platform. You may not copy, reproduce, scrape, or create derivative works from the Platform without prior written consent.
The following are strictly prohibited on the Platform: any item or service that is illegal under Pakistani law; counterfeit, stolen, or infringing goods; weapons, controlled substances, or regulated pharmaceuticals; any content that is obscene, hateful, defamatory, or that sexualises or endangers minors; any item prohibited under WhatsApp's and Meta's Commerce Policies; and any pyramid, multi-level, or deceptive scheme. FinGo cooperates with lawful authorities and will remove offending Content and report serious violations.
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. FinGo does not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components, nor does it warrant the quality, safety, or legality of any Seller's goods or services. Any reliance you place on the Platform is at your own risk.
To the maximum extent permitted by law, FinGo, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profit, revenue, data, goodwill, or business, arising out of or in connection with your use of the Platform, even if advised of the possibility. FinGo's total aggregate liability for any claim arising out of or relating to the Platform shall not exceed the total fees (if any) actually received by FinGo from you in the three (3) months preceding the event giving rise to the claim, or PKR 10,000, whichever is lower. Nothing in these Terms excludes liability that cannot lawfully be excluded.
You agree to indemnify, defend, and hold harmless FinGo and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) for Sellers and Partners, your goods, services, listings, or conduct.
FinGo may, at its sole discretion and with or without notice, suspend, restrict, or terminate your access to the Platform, remove Content, or withdraw Seller or Partner status, where it reasonably believes you have breached these Terms or applicable law, or to protect the Platform, its users, or FinGo. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) shall survive.
If a dispute arises, you agree to first contact FinGo in writing at support@fingodigital.com and to attempt in good faith to resolve the matter amicably. If unresolved within thirty (30) days, the dispute shall be referred to and finally resolved by arbitration by a sole arbitrator under the Arbitration Act 1940 of Pakistan, with the seat of arbitration in Karachi and proceedings conducted in English or Urdu. This clause does not prevent FinGo from seeking urgent injunctive relief from a competent court.
FinGo shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disaster, epidemic, war, civil unrest, government action, internet, telecommunications, or payment-network failure, or the act or omission of any third-party provider.
These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Subject to the arbitration clause above, the courts of Karachi shall have exclusive jurisdiction.
FinGo may amend these Terms at any time by posting the updated version on this page with a revised effective date. Continued use after changes constitutes acceptance. If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force, and the invalid provision shall be replaced by a valid one that most closely reflects the original intent.
All formal or legal notices to FinGo must be made in writing to the email addresses below and shall be deemed received upon acknowledgement by FinGo.
